Everyone is looking forward to the day that it becomes safe to lift COVID-19 restrictions and return to normal daily activities. When this happens, Notaries need to keep the following important points in mind when performing notarizations post-coronavirus:

1. Check The Deadline For Any Emergency Rules Regarding Expired Signer ID
2. Some Signers May Still Ask For PPE And Additional Safety Precautions 
3. Be Prepared For Appointment Challenges

Enjoyable Challenges

One of my most enjoyable assignments is for seniors. I enjoy the challenges presented such as expired identification, concern about their signatures not being as good as in their younger years and asking if I am comfortable.

I enjoy the conversation topics that present itself. I have learned about WW1, WW11, Korea and Vietnam from their perspectives. I have just a bit of knowledge with my family's military experience to keep the conversation going.

This morning I met with a couple staying at Aegis at Shadowridge. They are 92 years old and enjoying their life together. Their vim may not be what it once was, but their vinegar is
still going strong!

What if your identification has expired?

If a signer doesn't have a current ID, ( drivers license, passport, military ID with physical description) a Credible Witness is someone who can provide the proper identification, and is willing to swear or affirm that:

The individual appearing before the Notary Public is the signer of the document is the person named in the document; and

The Credible Witness personally knows the Signer; and

The Credible Witness does not have a financial interest and is not named in the document(s) to be signed.

Two Credible Witnesses are required in California, since Notary Public is no longer allowed to "personally know" the signer.

I  frequently receive notary assignments for assisted living residents and one of the major obstacles that is encountered is the proper identification for the  signer.

Seniors may allow their driver license to expire since they don't drive anymore.  The use of Credible Witnesses is an option that I offer at time of assignment. The family will "ask" staff or nurses to provide this service for the residence.   My experience is that most facilities will not allow staff to act as Credit Witnesses.

Be prepared with proper and valid current identification.

Seller Trust  -  Guest Blogger

In the event that the seller in a real property transaction is a
trust, the proceeds must be disbursed to the trust only; as the
payee of the proceeds must be identical to the vested owner of
record.  If the seller does not have a bank account open in the
name of the trust, one will have to be opened prior to close of
escrow.
 
In addition, it is critical that all parties to the escrow are
cognizant that there are various types of trusts and various
powers afforded to trustees.  Therefore, if asked to interpret trust
documentation, it would be wise to point them in the direction of
someone who is legally qualified to give such advice; i.e. a CPA
or attorney.

I read five suggestions that assist with time planning:

1. Acknowledge that there is time for everything that needs to be done....there will always be things left to do.

2. Honesty is key. (Don't create failure to do list) Be honest.

3. Procrastination is a fancy word for "no."

4. What is your current way of looking at time saving you from?

5. Start small..and keep going.

When do you need my notary services?

The first inkling a notarization is required is the notary verbiage.
There are two notary acts, Acknowledgment and Jurat.

Acknowledgment:

"...On___________before me_________personally appeared___________who proved to me on the basis of satisfactory evidence...."

Jurat:

"Subscribed and sworn to (or affirmed) before me on this___day of___...."

In CA a Will is not required to be notarized, however if you decide you would like it to be notarized, you will need to choose which notary act you wish. I can explain each certificate, however I can not decide for you.

Briefcase Early Morning

Hello All:

I have been busy this first week in Sept. 2014,  which I love however I’ve been taken out of the house before the rooster crows, at least it seems like it.  I don’t mind being busy riding all over San Diego County in Volvo feeling the breeze on my buckles and the smell of  Spring on my handles. What I do mind is being woken up from a sound sleep during my REM at 6am to go to Coffee N Contacts Networking Group in Carlsbad on Tuesday  and on  Wednesday  to go to BNI Platinum Professionals in San Marcos to substitute

for Steve Brown of Brown Roofing and then again on Thursday for North County Professional Network in Oceanside. I have not seen the sun come up in a very long time and I love the freshness of the air and the dew on Volvo (not me, yuck), but come on, Ms Robyn do we have to go this early?  

I just read what I wrote.  I didn’t know I was writing  out loud!  I do not want to seem like a grumpy briefcase.  I am not.   After our 9am loan signing in Escondido, I got the rest of the day off. Woo Hoo!   I had so much fun watching the birds, butterflies

and ladybugs playing in our backyard lounging while a cool breeze eased away my aches and pains.  I appreciate Ms Robyn’s family for taking her out for dinner - so I could re-energize and get ready for this next week of business going to  Oceanside Chamber of Commerce Ribbon Cuttings,  networking mixers and all of the loan signings and general notary assignments at Carlson Mobile Notary and Briefcase.

 I don’t know why my name was left off our business card?  Until next time enjoy being busy and remember to stop once in awhile and watch the birds, butterflies and ladybugs playing in your backyard.
